Terms of service

1. Introduction

Champs Only LLC and its members, officers, directors, owners, employees, agents, representatives, contractors, suppliers, and service providers (collectively “Asymmetric,” “we,” “us,” or “our”) provide this website (the “Site,” which also includes any email newsletter, landing page, or marketing property owned or operated by Asymmetric), Discord server (the “Discord,” which also includes any online community owned in whole or in part by Asymmetric), and any associated tools, software, scanners, dashboards, or applications owned or operated by Asymmetric (the “Tools”) for informational and educational purposes only.

Use of and access to the Site, Discord, Tools, and the information, materials, services, content, market analyses, trade discussions, interviews, streams, and other materials made available on or through them (collectively the “Content”) are subject to these Terms of Service and all applicable laws. By accessing, registering for, paying for, or using any Asymmetric service, you affirmatively agree to these Terms of Service, our Privacy Policy, our Cancellation/Refund/Chargeback Policy, our Risk Disclaimer, our DMCA Notice and Takedown Policy, and any other agreement we publish.

If you do not agree to any provision of these Terms, you must immediately cease using all Asymmetric services and request account termination.

2. No Investment, Legal, Tax, or Financial Advice

THE CONTENT PROVIDED BY ASYMMETRIC, INCLUDING BUT NOT LIMITED TO MARKET ANALYSES, TRADE IDEAS, EDUCATIONAL DISCUSSIONS, INTERVIEWS, LIVE STREAMS, AND ALL DISCUSSIONS WITHIN THE COMMUNITY, IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. NOTHING ON THE ASYMMETRIC SITE, DISCORD, TOOLS, OR ANY ASSOCIATED PROPERTY CONSTITUTES INVESTMENT ADVICE, FINANCIAL ADVICE, TAX ADVICE, LEGAL ADVICE, ACCOUNTING ADVICE, OR ANY OTHER FORM OF PROFESSIONAL ADVICE.

Asymmetric and Champs Only LLC are not registered investment advisers, broker-dealers, commodity trading advisers, commodity pool operators, futures commission merchants, or financial planners with the U.S. Securities and Exchange Commission, the U.S. Commodity Futures Trading Commission, the Financial Industry Regulatory Authority, the National Futures Association, or any other regulatory body. We do not offer financial services.

Any market analysis, trade idea, position disclosure, or commentary shared by Asymmetric founders, employees, contractors, or guest interviewees represents that individual's personal opinion and personal trading activity at the time of posting. Such content is not a solicitation, recommendation, endorsement, or offer to buy, sell, hold, or trade any security, commodity, derivative, prediction market contract, event contract, or other financial instrument by you or any other person.

Asymmetric is not a fiduciary. Users are solely responsible for their own trading decisions, for evaluating the merits, risks, and legality of any decision made in connection with information shared in the community, and for consulting their own qualified financial, legal, tax, and other professional advisers before taking any action.

Furthermore, no user-generated content — whether posted by paying members, free members, staff, contractors, or guests of Asymmetric — constitutes investment advice, and Asymmetric expressly disclaims any responsibility for financial actions, trades, or decisions taken based on such content. Members trade through their own accounts on third-party platforms and bear sole responsibility for all outcomes.

3. Use of Service at Your Own Risk

Users acknowledge that Asymmetric does not guarantee profitability, success, accuracy of information, or continued access to any third-party platform, including but not limited to Kalshi, Polymarket, Manifold Markets, PredictIt, Polygun, Discord, Whop, Fanbasis, Stripe, Kit (formerly ConvertKit), or any other platform or service referenced in or connected to Asymmetric services.

Users assume full and exclusive responsibility for any and all financial losses, account suspensions, account terminations, regulatory consequences, tax consequences, civil consequences, or legal consequences resulting from their participation in Asymmetric, their reliance on Content, their use of Tools, or their trading and financial activities of any kind.

Asymmetric is not responsible for any enforcement actions taken by third-party platforms, regulators, or governmental bodies, including but not limited to policy violations, account freezes, deposit holds, withdrawal restrictions, chargebacks, disputes, or legal proceedings arising from third-party services or user activities.

Automated tools, scanners, alert systems, copy-trading software, and any other Tools (whether owned by Asymmetric or by third parties) may produce errors, miss opportunities, generate false signals, or result in unintended trades, charges, or platform actions. Users assume full responsibility for all outcomes related to their use of any Tool, automated or otherwise, regardless of whether the Tool is owned, operated, or recommended by Asymmetric.

4. Prediction Markets, Trading, and Regulatory Status

Asymmetric is an educational community focused on prediction markets and event contracts. Users acknowledge and agree to the following:

• Prediction markets, event contracts, and similar instruments are speculative and involve significant risk of loss, including the loss of all funds deposited.
• The legal and regulatory status of prediction markets varies by jurisdiction, by platform, and over time. Certain prediction markets, contracts, or activities may be unlawful in your jurisdiction. It is your sole responsibility to determine the legality of your activities in your specific location.
• Asymmetric does not operate, control, or have any affiliation with Kalshi, Polymarket, Polygun, or any other prediction market platform or trading tool unless explicitly stated. References to such platforms are for educational and informational purposes only.
• Some prediction markets, including those operated by certain platforms, are not available to residents of certain U.S. states or countries. Users are solely responsible for confirming their own eligibility to access and use any platform.
• Tax treatment of prediction market winnings and losses varies by jurisdiction and by individual circumstance. Users are solely responsible for reporting and paying all applicable taxes.
• Asymmetric does not facilitate trades, hold customer funds, transmit money, custody assets, or have discretionary authority over any user's trading account. Asymmetric does not have API access to, control over, or the ability to execute trades on behalf of users on Kalshi, Polymarket, Polygun, or any other third-party platform. Users execute all trades through their own accounts on third-party platforms and bear sole responsibility for all funds, deposits, withdrawals, trading decisions, and outcomes.
• Asymmetric staff and contractors are compensated for producing analysis and educational content. Their compensation is not directly tied to whether members copy, mirror, or follow their personal trading activity, and Asymmetric does not receive payment from members for trade execution or trade copying.

5. Affiliate Relationships and Disclosures

Asymmetric may have affiliate, referral, or commercial relationships with third-party platforms, products, or services referenced within the Site, Discord, or other Asymmetric properties, including but not limited to:

• Kalshi and other prediction market platforms, where Asymmetric may receive a referral fee when a user signs up via a tracked affiliate link.
• Polygun (https://polygun.xyz/), a third-party copy-trading platform that is not owned, operated, or controlled by Champs Only LLC. Asymmetric may earn a commission when members sign up for Polygun via a tracked affiliate link. Asymmetric is not responsible for the operation, performance, security, regulatory compliance, or financial outcomes of Polygun. Users engage with Polygun at their own risk and subject to Polygun's own terms of service and privacy policy.
• Other third-party tools, software, or services referenced from time to time, where affiliate relationships will be disclosed.

These relationships do not constitute an endorsement of the third-party platform's services, an affiliation with the third party, a guarantee of any outcome, or a recommendation to use such services. Users should evaluate any third-party service independently and should not rely on the existence of an affiliate relationship as a basis for any decision.

6. Third-Party Links & Services

Asymmetric may provide links to third-party websites, applications, services, or platforms for convenience, but we do not control, operate, endorse, or guarantee these third parties. Users acknowledge that any transactions, information, or content obtained from third-party sites are at their own risk. Asymmetric disclaims any and all liability for damages, losses, account actions, or claims arising from third-party websites, services, products, or platforms, including but not limited to Kalshi, Polymarket, Polygun, Discord, or any other referenced platform.

Links posted on the Asymmetric Site, Discord, email newsletter, or any associated property may contain affiliate links from which Asymmetric may earn a commission, as described in Section 5.

7. User-Generated Content (Discord & Community Disclaimer)

Asymmetric is not responsible for user-generated content, including but not limited to messages, opinions, market analyses, trade ideas, strategies, screenshots, position disclosures, win/loss reports, or any other material shared by users in the Discord, on the Site, in voice channels, in live streams, in DMs, or in any community forum. Users acknowledge that information shared by other members does not represent Asymmetric's views and is not verified, endorsed, or guaranteed by us.

Profits, losses, returns, win rates, or any other claims made by community members regarding their personal trading results are self-reported, unverified by Asymmetric, and may be inaccurate, incomplete, exaggerated, or fabricated. Users should not rely on such reports as an indication of typical results, expected returns, or any guarantee of future performance.

Users are solely responsible for their contributions to the community and for any consequences, financial or otherwise, arising from reliance on information shared by other users. Asymmetric reserves the right to remove, edit, restrict, or moderate content that violates our policies, our Code of Conduct, applicable law, or community guidelines, but assumes no liability for harm caused by such content or by failure to remove such content.

8. Code of Conduct and Permitted Use

By participating in Asymmetric, users agree to abide by all community rules, including but not limited to:

• Treating all members with respect. Harassment, bullying, hate speech, threats, or discrimination of any kind is prohibited and will result in immediate removal.
• Refraining from spamming messages, links, advertisements, or unsolicited promotional content.
• Not sharing, distributing, leaking, or reproducing exclusive Asymmetric content (including but not limited to Vault interviews, market analyses, scanners, recordings, screenshots, or written materials) outside the paid community. Violation results in immediate permanent removal without refund and may result in legal action for breach of contract and/or copyright infringement.
• Not advertising, soliciting, recruiting, or directing other members toward any external or competing product, service, community, software, tool, platform, or commercial offering. This includes referral codes, affiliate links, DMs, voice channel solicitation, and indirect promotion. Violation results in immediate removal without refund.
• Not impersonating Asymmetric, its founders, employees, or other members.
• Not engaging in market manipulation, coordinated trading designed to influence prediction market prices, wash trading, or any activity that may violate the rules of any third-party platform or applicable law.
• Not posting investment advice, financial recommendations, or imperative trading directives (e.g., “you should buy”) to other members. All shared market analysis must be framed as personal opinion and personal trading activity.
• Not using Asymmetric content, market analyses, or community discussions to operate a competing service, newsletter, signals group, or trading community.
• Complying with all applicable laws and regulations, including securities, commodities, anti-money-laundering, tax, and consumer protection laws.

Asymmetric reserves sole discretion to determine whether a user has violated these terms. Violations may result in warnings, mutes, temporary suspensions, or permanent removal from all Asymmetric services without refund, in addition to any legal remedies available.

9. No Refunds & Chargeback Policy

All payments made to Asymmetric are final and non-refundable, except where required by applicable law. By purchasing any subscription, membership, founding member rate, annual plan, or other service, users acknowledge and agree that Asymmetric does not issue refunds for any reason, including but not limited to: unused time, dissatisfaction with the service, failure to cancel before renewal, change of personal circumstances, regulatory changes affecting the user's ability to trade, or any other reason except where required by applicable law.

Chargebacks or payment disputes initiated against Asymmetric will be contested to the fullest extent permitted by law. Users who initiate a chargeback agree that:

• Their account will be permanently banned from all Asymmetric services.
• They forfeit any access, status, badges, founding member rates, locked-in pricing, or other benefits associated with their account.
• They will be prohibited from rejoining under any new account, alias, or identifier.
• Asymmetric reserves the right to pursue legal action, collection efforts, and recovery of all costs (including legal fees) related to fraudulent or unjustified chargebacks.

It is the user's responsibility to manage their subscription through the relevant billing platform (Fanbasis, Stripe, Whop, or whichever processor is in effect) and to cancel before the renewal date if they do not wish to be charged.

10. Auto-Renewal & Subscription Terms

All Asymmetric memberships and subscriptions, including monthly, annual, founding member, and any other recurring plan, renew automatically at the end of each billing cycle unless canceled by the user before the renewal date. Users are responsible for managing their subscription and must cancel through the appropriate billing platform before the renewal date to avoid further charges.

No refunds, credits, or prorated reimbursements will be issued for canceled subscriptions, unused time within a billing period, or membership benefits not yet utilized. By subscribing, users authorize Asymmetric (and its billing processors) to charge the provided payment method for recurring fees, including any applicable taxes, until cancellation.

11. Founding Member and Promotional Pricing

Asymmetric may, from time to time, offer special pricing including but not limited to founding member rates, early-bird rates, locked-in annual rates, or other promotional pricing. The terms of any specific promotion are subject to these Terms of Service, the Cancellation/Refund/Chargeback Policy, and any specific terms published at the time of the offer.

Users who purchase at a promotional rate agree that:

• Promotional pricing is honored only for as long as the user maintains an active, continuously paid membership and Asymmetric continues to be operated by Champs Only LLC.
• If a user cancels, allows their subscription to lapse, initiates a chargeback, or has their account terminated for any reason, the promotional rate is forfeited and may not be reinstated.
• Promotional pricing applies to the specific subscription tier purchased and does not transfer to higher tiers, future products, or new offerings.
• Asymmetric reserves the right to modify benefits, features, services, or branding associated with any tier, including promotional tiers, at any time.
• In the event of a sale, merger, dissolution, restructuring, change of control, or change in operating entity, the obligations associated with promotional pricing may transfer in part, in whole, or not at all, depending on the structure of the transaction. Continued provision of promotional pricing under new ownership is not guaranteed.

Marketing language describing promotional pricing as “locked,” “locked forever,” or similar terms is intended to communicate Asymmetric's good-faith intention to maintain such pricing for active members under continued ownership. Such marketing language is subject to and qualified by these Terms of Service in all respects.

12. Intellectual Property and Limited License

All content, branding, trademarks, logos, materials, market analyses, interviews, recordings, written guides, scanners, code, software, designs, and other intellectual property associated with Asymmetric (collectively, the “Asymmetric IP”) is the sole property of Champs Only LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

Subject to a user's continued compliance with these Terms, Asymmetric grants users a limited, non-exclusive, revocable, non-transferable license to access and use Asymmetric IP solely for personal, non-commercial purposes within the scope of their active membership. Users may not:

• Copy, reproduce, distribute, publish, transmit, display, or otherwise share Asymmetric IP outside the community.
• Modify, translate, adapt, or create derivative works based on Asymmetric IP.
• Use Asymmetric IP for any commercial purpose, including but not limited to operating a competing service, training artificial intelligence systems, or selling derivative products.
• Reverse engineer, disassemble, decompile, or attempt to derive the source code of any Asymmetric Tool or software.
• Remove, alter, or obscure any copyright, trademark, or other intellectual property notices.

Unauthorized use, reproduction, or distribution of Asymmetric IP may result in immediate termination of access without refund and civil and criminal penalties.

13. Indemnification

Users agree to indemnify, defend, and hold harmless Asymmetric, Champs Only LLC, and its officers, directors, owners, partners, members, employees, contractors, agents, and affiliates from and against any and all claims, demands, lawsuits, losses, damages, liabilities, costs, fines, penalties, and expenses (including reasonable attorneys' fees) arising from or related to:

• The user's access to or use of Asymmetric services, Content, or Tools.
• The user's trades, financial decisions, or activities undertaken in connection with information obtained from Asymmetric.
• The user's use of any third-party platform or tool, including but not limited to Kalshi, Polymarket, and Polygun.
• The user's violation of these Terms or any applicable law.
• The user's violation of any third-party right, including intellectual property, privacy, or contractual rights.
• The user's content, posts, messages, or contributions to the Asymmetric community.
• Any chargeback, dispute, or refund request initiated by the user.

14. Disclaimer of Warranties and Limitation of Liability

ASYMMETRIC SERVICES, CONTENT, AND TOOLS ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED ACCESS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASYMMETRIC, CHAMPS ONLY LLC, AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF TRADING CAPITAL, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE ASYMMETRIC SERVICES, CONTENT, OR TOOLS, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STATUTE, OR OTHERWISE), EVEN IF ASYMMETRIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ASYMMETRIC'S TOTAL CUMULATIVE LIABILITY TO ANY USER FOR ANY AND ALL CLAIMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY THE USER TO ASYMMETRIC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, the limitations above shall apply to the maximum extent permitted by applicable law.

15. Jurisdiction & Legal Compliance

Asymmetric and Champs Only LLC operate under the laws of the United States and the State of Florida. Asymmetric makes no representations that its services, content, or materials are appropriate, lawful, or available for use outside of the United States or in any specific U.S. state.

Users are responsible for complying with all applicable local, state, federal, and international laws when using Asymmetric services, including but not limited to laws governing securities, commodities, prediction markets, gambling, taxes, anti-money-laundering, and consumer protection. Asymmetric reserves the right to restrict, suspend, or terminate access to its services in any jurisdiction where its services are prohibited, restricted, or where compliance becomes impractical.

16. Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

All disputes, claims, or controversies arising out of or relating to these Terms, the Asymmetric services, or any related matter shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, with arbitration to be held in Miami, Florida or via remote/virtual proceedings at Asymmetric's discretion.

Users waive any right to a jury trial and any right to participate in a class action, collective action, mass action, or representative proceeding of any kind. All claims must be brought in the user's individual capacity. The arbitrator may not consolidate more than one person's claims.

All claims must be initiated within one (1) year of the date the user first knew or should have known of the alleged incident, or they shall be permanently barred. Each party shall bear its own costs and attorneys' fees in arbitration unless the arbitrator determines that an award of costs or fees is appropriate under applicable law.

Notwithstanding the above, Asymmetric retains the right to pursue injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, or to prevent breaches of these Terms (including but not limited to leaks of exclusive content).

17. Modifications & Updates

Asymmetric reserves the right to modify, update, or replace these Terms at any time, in its sole discretion, by posting an updated version on the Site or providing notice through the Discord, email, or other means. The “Effective Date” and “Last Updated” lines at the top of this document will reflect the most recent revision.

Continued use of any Asymmetric service after a modification constitutes acceptance of the revised Terms. Users who do not agree to a modification must immediately cease use and request account termination.

18. Severability

If any provision of these Terms is held to be unenforceable, invalid, or contrary to applicable law by a court or arbitrator of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, Cancellation/Refund/Chargeback Policy, Risk Disclaimer, DMCA Notice and Takedown Policy, and any other policies referenced herein, constitute the entire agreement between the user and Asymmetric regarding the use of Asymmetric services, and supersede all prior or contemporaneous agreements, understandings, or representations, whether written or oral.
