DMCA notice and takedown policy

1. Introduction
Champs Only LLC, doing business as Asymmetric (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of its services to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), as set forth at Title 17 of the United States Code Section 512, we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent identified below.
2. Filing a DMCA Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that copyrighted material has been used in a manner that constitutes copyright infringement on the Asymmetric Site, Discord, or any associated property, please submit a written notice (a “DMCA Notice”) to our designated copyright agent.
Pursuant to 17 U.S.C. § 512(c)(3), a DMCA Notice must include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
- Identification of the material claimed to be infringing or the subject of infringing activity, with information reasonably sufficient to permit Asymmetric to locate the material.
- Information reasonably sufficient to permit Asymmetric to contact you, including your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

3. Counter-Notification
If you believe that material you posted on Asymmetric was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. Pursuant to 17 U.S.C. § 512(g)(3), a valid counter-notification must contain:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which Asymmetric may be found, and that you will accept service of process from the person who provided the original DMCA Notice or an agent of that person.
4. Repeat Infringer Policy
Asymmetric maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Asymmetric services or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5. Misrepresentation
Pursuant to 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages. Please consider carefully before submitting a DMCA Notice or counter-notification.
6. Note Regarding Designated Agent Registration
Champs Only LLC is in the process of formally registering its Designated Copyright Agent with the U.S. Copyright Office in accordance with 17 U.S.C. § 512(c)(2). Once registration is complete, this Policy will be updated to reflect the registered agent's information. Until such registration is finalized, this Policy nonetheless governs the procedure for submitting and responding to [content truncated — please send the remainder of Section 6 and any subsequent sections].
